Transvaginal Mesh Lawsuit News: Federal Appeals Court Asked to Uphold $2 Million Verdict in C.R. Bard Bellwether Trial

Transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/ ) involving devices manufactured by C.R. Bard, Inc. continue to move forward in courts around the U.S. According to court documents dated June 1st, the plaintiff whose case was selected for the first federal bellwether trial involving C.R. Bard has asked the U.S. Court of Appeals for the Fourth Circuit to uphold the $2 million verdict she was awarded by a West Virginia federal court jury. In doing so, the plaintiff asserted that the original trial court was correct when it deemed certain evidence related to the regulatory clearance of the Avaulta Plus mesh product inadmissible. Transvaginal Mesh Litigations
Court documents indicate that more than 11,000 transvaginal mesh lawsuits are pending against C.R. Bard in the federal multidistrict litigation underway in the U.S. District Court, Southern District of West Virginia, all of which were filed on behalf of women who allegedly experienced severe and life-changing complications following implantation of surgical mesh devices to treat pelvic organ prolapse and stress urinary incontinence. According to court documents, the litigation's first bellwether trial concluded in August 2013, with a jury finding that C.R. Bard was liable for the vaginal mesh complications experienced by a woman who received the company's Avaulta Plus mesh device to treat pelvic organ prolapse. After just 12 hours of deliberations, the panel awarded the plaintiff $250,000 in compensatory damages, along with $1.75 million in punitive damages.

According to court records, the federal C.R. Bard litigation is just one of seven vaginal mesh proceedings currently underway in the Southern District of West Virginia, where more than 75,000 complaints have been filed. Other proceedings include: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In Re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; In Re: Coloplast Corp. Pelvic Support Systems Products Liability Litigation - MDL No. 2387; In Re: Cook Medical, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2440; In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327; and In Re: Neomedic Pelvic Repair System Products Liability Litigation - MDL No. 2511.
