Court says Don Siegelman can't be freed while appealing case

A federal appeals court has ruled against a request by former Alabama Governor Don Siegelman to be released while his appeal in pending.

The 11th Circuit Court of Appeals in Atlanta said the former Democratic governor must remain behind bars while appealing his case. In April, Siegelman was granted a hearing to request a new trial. That hearing was scheduled to begin in July but was later moved to October and now is expected to take place in early 2015.

Siegelman's attorneys have maintained the prosecution was marred by judicial mistakes and politics.

Siegelman and former HealthSouth CEO Richard Scrushy were convicted of bribery and other charges in 2006. After appeals, Siegelman was sentenced to six years in prison in 2012 and is currently incarcerated in Louisiana.
