Boston Scientific Transvaginal Mesh Lawsuit Trial A Win For Plaintiffs, As Jury Awards $18.5 Million to Obtryx Victims, Bernstein Liebhard LLP Reports

A jury in West Virginia hearing the second federal trial to involve transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) filed against Boston Scientific Corp. yesterday rendered a verdict in favor of four women who suffered complications from the company's Obtryx bladder sling device. According to court documents filed in the U.S. District Court, Southern District of West Virginia, the jury awarded the plaintiffs a total of $18.5 million, including $4 million in punitive damages, following six hours of deliberations. In doing so, the jury found that Boston Scientific failed to provide adequate warnings regarding the risks associated with the Obtryx implant. (Tyree v. Boston Scientific Corp., No. 12-cv-8633)

This was the second loss in federal court for Boston Scientific. Just last week, a jury hearing a vaginal mesh lawsuit involving its Pinnacle Pelvic Floor Repair Kit in the U.S. District Court, Middle District of Florida awarded more than $26 million to four women who were injured by that device. Vaginal Mesh Litigation
According to court documents, Boston Scientific is named a defendant in more than 14,000 transvaginal mesh lawsuits that have been filed in a multidistrict litigation established in the U.S. District Court, Southern District of West Virginia. All of the claims pending in this proceeding were filed on behalf of women who allegedly suffered mesh erosion, chronic pain, organ damage and other serious vaginal mesh complications as a result of the company's products. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs' Steering Committee in the federal Boston Scientific litigation. Court records indicate that Boston Scientific has also been named in thousands of vaginal mesh lawsuits pending in state courts around the country. In September, a jury in Texas ordered the company to pay $73 million in punitive and compensatory damages to another Obtryx mesh victim. However, punitive damages were later reduced in the case to comply with Texas law, reducing the total judgment to $34 million. (Salazar v.
