Lipitor Lawsuits Move Forward in Federal Multidistrict Litigation, as Court Rules on Pfizer's Motion to Dismiss Certain Cases

The federal court overseeing thousands of Lipitor lawsuits (http://www.lipitorlawsuitcenter.com/) that allege the statin medication increases the risk that a patient will develop Type 2 diabetes has granted Pfizer Inc.'s Motion to Dismiss four individual cases that had been filed in the proceeding. According to a Case Management Order issued in the U.S. District Court, District of South Carolina, on March 23rd, the Court determined that the dismissals were warranted because the plaintiffs in those claims had not complied with certain discovery orders. "The Court did dismiss these claims without prejudice, which means that plaintiffs will be permitted to refile their cases, so long as they comply with stipulations set forth in the Order. More than 2,000 Lipitor lawsuits are now pending in the federal litigation underway in South Carolina. According to court documents, the cases were filed in the wake of an alert issued by the U.S. Food & Drug Administration (FDA) in February 2012, which warned that cholesterol-lowering statins like Lipitor might be associated with an increased risk of new-onset Type 2 diabetes. At the time, the agency disclosed that it would require that new information be added to the labels of Lipitor and other statins regarding their potential effect on blood glucose levels.

Court records indicate that all of the pending claims accuse Pfizer of concealing the link between Lipitor and diabetes, and of failing to warn doctors and patients of this possible side effect. Plaintiffs further allege that the information added to the Lipitor label in the wake of the FDA's 2012 mandate still does not adequately warn patients about the drug's association with diabetes.
