MDL Judge Denies C.R. Bard’s Motion for New Trial in Cisson Transvaginal Mesh Case

CHARLESTON, W. Va. — A West Virginia federal judge has denied C.R. Bard Inc.’s motion for a new trial in a bellwether transvaginal mesh case, finding the manufacturer was not deprived of a fair trial.

On Jan. 20, Judge Joseph R. Goodman of the U.S. District Court for the Southern District of West Virginia ruled that Bard was not prejudiced by the exclusion of evidence regarding its compliance with the 510(k) process. The judge further held that the Material Safety Data Sheet that accompanied the polypropylene resin material was properly admitted into evidence.
