The Internet Archive Just Made a Ton of Old MS-DOS Games Available for Free

Nearly 2,400 of them, to be more exact.

If you have a lot of spare hours in your day and would like to spend some of them trying to figure out if you remember any of Carmen Sandiego's world history lessons, great news! The Internet Archive--the people behind the Internet Wayback Machine and the browser-based Console Living Room--has just gone and added 2,388 MS-DOS games to its Software Library.

Among them, you can find any number of classics, like edutainment stalwart The Oregon Trail, the turn-based space strategy game Master of Orion, and Taito's Bust-a-Move, which I only mention because the MS-DOS version of Bust-a-Move was the only one I ever played as a kid. I had a weird childhood.

All of the games are playable within supported web browsers, and based on my quick skimming through a half-dozen titles today, it seems like the emulation is generally solid. Still, you may run into some issues, according to archivist Jason Scott's announcement post.

First, I really worked hard to have only fully-functioning programs up, or at least, programs that gave viable, useful feedback. Some of them will still fall over and die, and many of them might be weird to play in a browser window, and of course you can’t really save things off for later, and that will limit things too. But on the whole, you will experience some analogue of the MS-DOS program, in your browser, instantly.

You may run into some other quirks, too. Some games--like Stunts--have noticeable audio issues, and if any games had security checks that required you to enter words from the originally included manual, you still have to enter those words to proceed. Seemingly, some kind-hearted souls have been adding those check word solutions to game pages in the form of user reviews.

You may also be asking yourself "Is any of this legal?" That's a great question, but we don't immediately have the answer. Plenty of sites have offered games like this under the guise of them being "abandonware," but that's always felt more like people looking the other way because many of the games' copyright holders have been defunct for years. Is Warner Bros. going to waste the time and effort required to come after this site for offering the crappy DOS port of Total Carnage for free? Probably not.

Still, as a browser-based way to play hell of old games many of us grew up with, this is a pretty neat thing. I already beat Oregon Trail twice today. Now let's see if I can do it as a farmer.

UPDATE: Giant Bomb user @overbite helpfully pointed out that the Internet Archive folks have a DMCA exemption from the Copyright Office, which allows the site to archive:

  • Computer programs protected by dongles that prevent access due to malfunction or damage and which are obsolete.
  • Computer programs and video games distributed in formats that have become obsolete and which require the original media or hardware as a condition of access.

It's worth noting that the exemption notice is from 2003, and it was evidently renewed in 2006. We can probably assume that the Copyright Office hasn't made any recent changes to its exemptions that would make what's been done here an issue, but given that the most recent confirmation of the exemption is from nearly 10 years ago, it's tough to say for certain. Still, it seems like the IA is at least trying to keep this within the letter of some kind of copyright law. So if guilt is in any way preventing you from playing these archived games, hopefully this assuages that a bit.

It's not theft, might be illegal, but it sure ain't theft. Particularly if the company making the product is no longer selling it, nobody has lost anything.

Put another way, if I had a really good 3d printer and could print out those plastic figurines crazy people spend ungodly amounts of money on, you'd call that theft? Building a patented device from a blueprint on my own, would that be theft?

Same thing as copying digital code but takes more effort, it's not legal, but it's not theft. It's another idea entirely and it's only going to get worse over the next decade as more of those things become possible. Hell, aren't those 3d printers really good these days?

@cornbredx: The interesting case for me is with games made by companies that no longer exist and where the ownership rights are murky at best. Even if some dude did pay a small sum in an auction for those rights, he or she isn't the creator of the game. If the game is still being sold by its original creator(as is the case with a lot of old EA PC games) then there is a fair moral argument against it.

The thing is, copyright laws are stacked in favor of large corporations. When US copyright law started, a work could be copyrighted for a maximum of 28 years. Under those rules, many of these games would now be in the public domain, and those whose original owners went bankrupt would have been in the public domain for over a decade. Over time, though, Disney has lobbied congress, turning 28 years into 75 years in 1976 and 75 years into 120 years in 1998. The goal of copyright initially was to give creators a chance to profit from their creations, while eventually giving the work to the public to possess freely. In some nations, especially communist ones, this is still the case.

There are reasons to follow modern copyright laws, mainly that you'll be arrested if you don't. But don't for a minute feel morally obligated to uphold copyrights that are more than 3 decades old. That was never the point of copyright law and just because Disney paid members of congress off to change the federal law, and to have it override a variety of State and Local laws that were much less far reaching, doesn't make it right.

Even if the games themselves are given an exception having things like "Disney's Aladdin" and "Donkey Kong" on there ensures this will be taken down quickly.

Even if they're shitty old dos versions they "misrepresent the brand" or some crap and they'll have them removed for no reason.

What a wonderful step in the right direction. Even if it leads to legal trouble it might bring about a more solid solution for copyright issues like these. It's really about damn time we tried to tackle the issue of archiving "obsolote" games. I have a lot of respect for archive.org for giving it an honest shot!

When I was 6 I figured out I always had to play banker to get very far. After that, I tried farmer. I remember that, vaguely, to this day. "...What am I even really supposed to do?". It was on school computers so I never beat it. Even as banker.

Nothing like setting out with obscene amounts of ammo and just constantly hunting waaaaay too much buffalo to eat. At school, under the guise of education.

Interesting for sure, but everything I tried had horrible sound emulation problems and generally didn't run all that well. Of course, I already have most of the things I recognise from the DOS age running on DOSbox myself anyway, so I'm not missing out really.

Animal Quest is the original Tokyo Jungle.

WHAT THE FUCK!? I used to love that game when I was a kid. Well, I loved it, but I was terrified of it. The bear (and same-tier animals) was OP, but the rest of the animals were terrifying to play as for a young mind like mine! Too bad it's just the shareware version. I'd love to play the other three episodes, which I never got to play when I was a kid.

I noticed they have a CD-ROM Software Library collection, too. While they aren't playable online (and may take more work to get running), there are a bunch of ISOs to download. Are these also considered legal for anyone to download?

I didn't really find any description about legality of items in their CD-ROM Software Library. In their general Terms of Use, they note:

The Archive does not endorse or sponsor any content in the Collections, nor does it guarantee or warrant that the content available in the Collections is accurate, complete, noninfringing, or legally accessible in your jurisdiction, and you agree that you are solely responsible for abiding by all laws and regulations that may be applicable to the viewing of the content.

So I guess the legality is still in question, as the GB article implies.
