COURT: Millionaire estate agent Devinder Kainth could be spared jail

Millionaire estate agent Devinder Kainth was given a six-month prison sentence after admitting the manslaughter of oddball computer programmer Sandro Rottman at a restaurant in the upmarket Spanish resort of Sotogrande.

He received the punishment after striking a deal with state prosecutors ahead of his trial at a court in Algeciras.

The sentence is set to be suspended because first-time offenders are normally not forced to do jail time unless they get two years or more.

Rottman, 43, died in hospital after being attacked by estate agent Kainth, 39, in Spinnaker Restaurant on February 7.

The Brit, who was out for a meal with his stunning partner Gemma Hawkins and their three young children, went ballistic after spotting pictures of his kids on his victim’s iPad.

The German, who once helped Katie Prince launch a polo clothes range in Sotogrande, was being investigated at the time by a judge after police discovered child porn on his computer.

Judge Raquel Gomez Sancho, who sentenced Kainth after the court deal was sealed, ruled heavy-drinking Rottman’s alcohol-related health problems had contributed to his death.

In a two-page document released after a short hearing at Algeciras Criminal Court Number Two, she said: “Around 10pm on February 7, the accused was dining with his family at Spinnaker Restaurant in Sotogrande and German national Sandro Rottman was using an iPad in the same restaurant to take photographs among other things.

“When the accused finished eating and got up to leave the restaurant he realised as he talked to Sandro that he had been taking photos of his children without his consent.

“This really upset the accused and led to him shouting at Sandro that he should erase them whilst he demanded he explain his actions.

“The tense situation led to a fight in which the accused punched Sandro several times in the head.

“They were punches that would not normally have caused Sandro’s death.

“But due to a severe liver cirrhosis that the victim suffered which the accused was unaware of, the bleeding the punches caused him led to Sandro dying minutes afterwards.”

Manslaughter convictions in Spain normally carry prison sentences of one to four years.

But Kainth's emotional state when he attacked Rottman - after seeing the pictures of his children - was accepted as a mitigating factor.

Police revealed after Rottman’s violent death that he was facing trial after being caught in possession of child pornography.

Officers said they discovered sickening images on his laptop after being called to a suspected break-in at his home.

Gym fanatic Kainth, known to friends as Victor, was held on remand at maximum-security Botafuegos Prison in Algeciras before being released on bail.

He and his glamorous London-born partner Gemma, mum to his two boys and one girl, went to ground after his release and have never spoken publicly about the incident.

Sotogrande is a favourite of Sarah Ferguson, 56, and her daughters Beatrice and Eugenie.

Rottman, who drank three bottles of vodka a day and had been banned from several bars in Sotogrande over unpaid bills, helped organise model Katie Price’s August 2009 trip to the resort to promote her polo clothing range and was pictured chaperoning her and ex Alex Reid.

A spokesman for Miss Price confirmed after learning of the German’s death: “Katie was present at an event where Mr Rottman was working for the organisers.”

In a full statement later released, she said: “I had no recollection of meeting him as he was not my assistant but it appears I did during the course of my one day working trip to Sotogrande promoting KP equestrian.

“This is clearly a tragic incident that will impact the families of all involved.”

Kainth’s defence lawyer could not be reached for comment.
