A 34-year-old man accused of being responsible for a four-car accident on State Route 92 that killed his 70-year-old mother was charged Tuesday with vehicular manslaughter and causing injury to others while driving under the influence of alcohol, according to the San Mateo County District Attorney’s Office.
Arsen Tarkovskiy did not enter a plea when he appeared in court Tuesday, just one day after he was discharged from Stanford Hospital where he was being treated for serious injuries following the Oct. 21 crash, according to prosecutors.
Tarkovskiy was allegedly on his way to his Los Gatos home with his mother, a Los Gatos resident named Saida Magomedova, in the passenger seat of a Mercedes-Benz when he crossed double yellow lines and drifted into oncoming traffic just west of Interstate 280, according to prosecutors.
He allegedly crashed into an eastbound 2003 Honda CR-V head-on, and then subsequently crashed into a 1998 Pontiac Grand Prix and 2003 Volvo SUV, which were also traveling east, according to police.
The collision was allegedly reported at 8:44 p.m. and first responders had to extricate Tarkovskiy from the Mercedes, according to police.
Though Magomedova was pronounced dead at the scene, no major injuries have been documented for the drivers of the other vehicles, according to prosecutors.
Though police noted a strong odor of alcohol on Tarkovskiy’s breath and slurred speech after the accident, officials were not able to conduct an alcohol screening until close to three hours after the accident, when he logged an estimated .09 percent blood-alcohol content on the hand-held device officials used. A blood sample taken to measure the amount of alcohol in his system has not yet been returned, according to prosecutors.
District Attorney Steve Wagstaffe confirmed Tarkovskiy has a prior DUI conviction from 2012, but was no longer on probation the day of the accident. He will next appear in court Nov. 7 for entry of plea and is in custody on $325,000 bail, according to prosecutors.
