Grayson Allen isn’t the only one that’s trippin’.
Duke University is suing Smack Apparel for making T-shirts mocking Allen. A cease-and-desist has been sent to the clothing company asking them to stop making the shirts, according to TMZ.
The T-shirt is blue, with the shadow of Allen in a number 3 jersey with the words “Yo Grayson… Why You Trippin’?”
The NCAA requires universities to take action against companies who are profiting off college athletes.
Wayne Curtiss, the owner of Smack Apparel responded to the cease-and-desist with a letter of his own claiming he had the right to make the shirt under the First Amendment.
“In my opinion, no one would believe our shirt to be sponsored or endorsed by Grayson Allen but rather it is humorous and clearly making fun of him,” Curtiss wrote in the letter obtained by TMZ.
He also made a counter offer suggesting he’d fly to Duke to ask 50 people if they think the shirt is sponsored by Duke or Allen. If more than five say “Yes,” he’ll stop making the shirt. However, if they say “No,” he wants Duke to pay him back for making the trip.
Smack Apparel has not taken down the Allen shirt and it looks like they’ll continue to sell it.
As of Monday, the T-shirt is still available for sale for $19.99 on the brand’s website and is currently one of the featured products.
