HALLE BERRY has reportedly made some shocking accusations about her ex Gabriel Aubry during a complicated custody battle over their daughter Nahla, according to recently unearthed court documents.

Halle Berry, 53, and French Canadian model Gabriel Aubry, 43, announced the end of their relationship in 2010 and then became embroiled in a highly publicised custody battle over their daughter Nahla, who was born in 2008. Court documents from 2011, which have been obtained by RadarOnline, have now been unsealed, reportedly revealing the actress’ serious accusations about her ex’s behaviour which contributed to their split.

Halle is said to have claimed Gabriel used racial epithets during their relationship and also refused to recognise their daughter as biracial.

The Hollywood star went on to address Gabriel’s past sexual relationship with a member of his family and suggested the emotional damage from the incident negatively impacted the couple’s sex life, it is claimed.

According to legal documents, Halle testified: “After the first six months of our relationship, our sex life diminished and after one year we had sex less than three times per year.”

She added: “[Gabriel] refused to either recognise or accept responsibility for these issues.”

Halle went on to accuse Gabriel of emotional abuse and claimed he “criticised her body”. 

She continued: “Instead, he criticised my body in ways which are very demeaning to women… 

“I finally convinced [him] to go to a joint therapist to address these issues.”

The Catwoman star claimed Gabriel admitted to having sexual relations with a family member “for years” while he was between foster homes.

Halle also accused Gabriel of having mental health issues which meant he was unsuitable to be Nahla’s primary parent.

She said the model, whom she first met at a Versace photoshoot, was suffering from depression and social anxiety but declined any treatment, which partly caused their break-up.

However, Gabriel’s lawyers requested the court strike the majority of Halle’s testimony from the record due to “misstating facts” and claimed the allegations had “no foundation”.

The legal team also protested the claims about their client’s mental health for breaching therapist-client privilege.

Gabriel and Halle’s custody dispute was based on the actress’s decision to move to France with Nahla in order to live with her then-boyfriend Olivier Martinez.

Gabriel said his ex’s move would interfere with their joint-custody agreement at the time.

A judge denied Halle’s request to relocate with Nahla in November 2012.

Express.co.uk has contacted representatives for Halle Berry and Gabriel Aubry for comment.

Two weeks after the ruling, Gabriel and Olivier got into a physical altercation at Halle’s home in California, which resulted in them both going to hospital with injuries.

Gabriel was left with a severely bruised eye, which was seen in pictures that emerged after the brawl with Olivier.

Oliver, Halle, and Nahla were then granted temporary emergency orders against Gabriel, which expired on November 29 2012.

Gabriel responded at the time by getting his own temporary restraining order against Olivier, which he then dropped on November 30 2012, according to TMZ reports.

No charges were filed after the incident and Halle and Gabriel decided on terms for Nahla’s custody arrangement.

Back in 2014, a Superior Court ruled Halle pay Gabriel $16k a month in child support alongside a retroactive payment of $115k and $300k to reimburse him for his attorney fees.
