The rape of a Kansas City student may have parents asking: Who can pick up my kids?

Who is allowed to pick up children from their school?

A lawsuit filed against Kansas City Public Schools may spur parents in Springfield — and throughout Missouri — to double-check pick-up procedures at the schools where their children are enrolled.

In the suit filed last week, a woman alleged she was picked up at school in May 2010 by a violent convicted felon, not on her parents' approved pick-up list, who took her to a hotel and raped her.

The woman, now 21, was 14 at the time, the Kansas City Star reported.

The suit filed by attorney Gerald McGonagle named Kansas City Public Schools and two individuals employed at the time by Lincoln College Preparatory Academy, where she was enrolled.

The woman, identified only as Jane Doe, alleged in the suit that the district violated its own policies by releasing the student to an individual who was not on the authorized list filled out by her parents.

Springfield Public Schools, the largest district in Missouri, said its policy requires school employees to adhere to dismissal rules. The policy, with wording suggested by the Missouri School Boards' Association, was originally adopted in 2015.

In addition to requiring principals to establish procedures to "validate requests for early dismissal," the policy states:

  • Students will only be released to the parent, guardian or designee of the parent or guardian, or to other individuals or agencies as permitted or required by law
  • The district will release a student to either parent unless the district has a valid court order directing otherwise or unless the parent requesting release is only entitled to supervised visitation
  • If district staff have concerns about releasing the student to a parent, the student may be held while additional precautions are taken, including, but not limited to, verifying custody orders, contacting the other parent or contacting appropriate authorities
  • Students who are 17 years old and living independently and students 18 or older must validate their own attendance and dismissal
  • Telephone requests for early dismissal of a student shall be honored only if the caller can be positively identified as the student’s parent or guardian
  • Any person requesting release of a student must present proper identification prior to release of the student

The Springfield district requires the parents or legal guardians of students to designate a list of approved individuals who may pick up that student.

That list is developed at the time of the student’s enrollment and is verified annually. It includes the names, contact information and the relationship to each student.

Under its pick-up procedures, each time a student is picked up by an adult, the district cross-checks the name of the person with the approved list and confirms or verifies their identity through a photo ID.

Parents have the option of revising the list of approved individuals who can pick up their children at any point during the school year.
