Attorney for suspects accused in Madison Brooks sexual assault, death speaks
Good afternoon everyone, we have found ourselves at *** point in our careers that none of us have imagined. We have families, we have mothers, we have sisters and daughters. *** string of events ultimately led to the unfortunate death of *** young girl, Madison brooks and this of course has captured the attention of our city, the state and the nation. We do not intend on trying this case in the media. We do however, intend on to state the pertinent facts of this case while being as sensitive as possible to all parties involved. Here are the facts of the case. With the latest developments. MS brooks was confirmed on video dancing and talking with the juvenile defendant inside of the car. Miss brooks exited the bar, approach the defendants and asked him for *** ride which was confirmed on video, which was released last night. The two defendants who engaged in *** consensual sexual act with Miss brooks did so after obtaining verbal consent. The way this is being reported and taken out of context from the police report is factually inaccurate. MS brooks asked to be dropped off at *** sorority Sisters house in Pelican Lakes. The driver complied. MS brooks left the car on her own volition saying that she would get an Uber. She has seen on video leaving the car unharmed and in good health. This will be confirmed by video at *** later date. Now, this is *** very important clarification. The video taken in the car is only *** conversation between the parties and do not depict any sexual acts that was not specified when it was mentioned previously for any fault of ours. We apologize as the facts of this case continue to come forth? We believe that intent and consent will be very clear. While we understand that the media has *** duty to inform the public. We will not release these videos. Now we're working with the D. ***. It will allow the judicial process to take place again. We will not try this case in the court of public opinion or in the media. While this is *** horrible tragedy resulting in *** horrific accident, we truly believe the facts will prove that this was not *** rape. We meet here only today to correct the record on some of the allegations have been made against our clients. We hope that the public will understand and that we cannot and will not share everything that we have both out of duty as officers of the court and out of respect for the victim's family. Now this time I'm gonna invite attorney long enough with me and we'll take any questions that the media has questions please. The other video that you mentioned, Attorney Haley about the conversation between your clients and Miss brooks. Can you talk about the timeline and get *** better picture? Was that after the encounter? I know it doesn't show the sexual encounter but is that after that had happened. Yes, it is. Can you talk about how law enforcement went from investigating? Have to talk to the sheriff's office about that? We don't know what led them to do this. We have our ideas, but we're not going to speculate, can you speak to the video that was released um late last night about the all the parties leaving the bar around I think 1 50 last night. And you kind of talk *** little bit about that video. We didn't release the video. That was uh that was W. B. R. Z. That released the video, but it confirms what we've said all along, that my clients left, uh my client and their client's all left and they were getting ready to leave and miss brooks approach them from the bar. And I think the video is the best evidence of what happened, but it's consistent with what our clients have always told the police anything else. Mr You mentioned verbal consent was obtained. I mean, the law enforcement records are clear, that content .319. How do you uh how can you obtain verbal consent from? Well, I will say this, that we plan on hiring expert witnesses. If anyone does any casual research on what *** .319 is that is alcohol poisoning and potential death Based on her actions that evening leading up to get into the car with the young man based on the fact that information from Reggie's have come out to say that she did not have any other alcoholic beverage from around 1250 into the time that she left gives us reason to believe that the results of that those results are inaccurate. And I would just add that If you have *** .319, your motor skills shut your body down. You can't walk, you can't talk your lapsing in and out of blackout and you risk death. Read it, read the symptoms of *** 0.319 B. ***. C. The evidence that we've seen so far on the video of MS brooks running across the street in front of Reggie's, that undermines the police version of events. And until our experts can look at what happened, we believe that the B. ***. C. That they're saying is inaccurate. Can you explain the charges? Jack clowns? Let's face it. Yeah. Uh Two of them uh Mr Washington was who was in the front seat and mr Carver who was in the front seat. They have been charged with principal to third degree rape which means they aided or abetted or assisted. Uh The other two men in the rape. The other two men the juvenile and Mr lee correct are charged with third degree rape, which means excuse me, Mr Washington. They're charged with third degree rape which means that they had sex with her and she could not legally consent because of *** condition of alcoholic stupor. And if you read alcoholic stupor says very much like the 319 says it says in and out of consciousness incapable of talking of walking uh and we don't believe that the evidence that we have which we will show that when the time is right shows that she's in an alcoholic stupor at all that she is aware of her surroundings. And uh we don't think that the state can prove that there was *** crime here staying on those charges. Prosecutors have said they wanted to possibly upgrade those charges to first degree rape, 1st 1st degree uh principle to rape. What's your response to that? That's not what was said. If you were at the bail hearing, you know, you can get *** transcript of it and find out what he really said. I'm not going to speak to the D. ***. On that. But he did not say he was gonna upgrade him the first script. Well he said based on what evidence comes out, it's *** possibility. I spoke with him after the fact. What do you have to have to prove first degree rape? You have to prove that it was non consensual right? There's no in there about alcoholic stupor and first degree right. You have to prove that it was non consensual. They would have *** very difficult to uh time proving any of that. But the D. ***. Is gonna do whatever they can they can charge you with whatever we are confident that whatever charges end up being on our clients that we were going to prevail. So was your client drinking as well? Well, any conversation that I have with my client, I'm not going to share with the media, but they did go to *** bar. So you got common sense? Well, I mean, *** lot of people go to the bar and some people don't even drink. They just go, because they like going, going out. If she was drinking, there was drinking there saying that she didn't know who he is and what she was doing. It could be the same thing with your class, Right? I'm not gonna answer about what my client was doing, but thank you for the question. What do you, uh, what do you have to say about the other women that I've said that they've also been raised by Washington. I didn't know anything about that. But I can just tell you this, that they go to the police where they arrested, indicted where they tried. We're not gonna argue, we're not gonna argue about hypotheticals and rumors. All we know is if there was any credible evidence that any of our clients had done, anything like that, it would have come out in the mail here. Do you mind speaking *** little bit more to the videos that you all are holding? We're not going to speak with at this time and you have to understand that we cannot give you all of our strategy at this time is very early on in the case. But I promise you that when we make the decision to release it, we will release it. And when you, when you see it, or when *** reasonable jury sees it, they will know for sure that this was not *** can you speak to um, what role uh, defending this case in *** in the unusual situation of having *** sexual assault victim there is no longer alive will play? Well, that's an interesting question. We believe MS brooks was alive. This would not be *** crime. She would not have complained about it at all. And so the only reason it's there is because the understandable anger in the community wants someone to pay for her death. We understand that, but our clients did not do that.

The attorneys for the suspects accused in the sexual assault and death of Madison Brooks held a news conference Friday. Brooks, a Covington native, was struck and killed at the intersection of Burbank Drive.According to the attorneys, they have video evidence that confirms that Brooks exited their clients vehicle in good health. The attorney's also said that the juvenile client accused of sexually assaulting Brooks was given verbal consent for the sexual encounter. This comes after three of the four suspects in the case were released on bond. Four suspects have been arrested for involvement in the case. Two of those suspects, Everette lee, 28, and Casen Carver, 18, bonded out of prison on Tuesday. A third suspect, Kaivon Washington, 18, posted bond on Wednesday. According to East Baton Rouge Police Department, a 17-year-old juvenile and Washington are being accused of third-degree rape.Carver and Lee are accused of witnessing the crime and face accessory charges. Baton Rouge police say Brooks left Reggie's Bar in Tigerland with the suspects when she asked for a ride home. Washington and the unnamed juvenile are accused of raping her in the rear seats while the other two suspects were in the front seat. The four suspects then dropped her off at a random location, which led to her being hit by a vehicle around 3 a.m. on Burbank Drive near Pelican Lakes Parkway. Deputies say Brooks' toxicology reports show her blood alcohol content was .319g%. According to the University of Notre Dame Research, the effects of a BAC between .350g% and .399g% are listed as alcohol poisoning. Tetrahydrocannabinol was also found in her system. LSU President William F. Tate IV released the following statement: This afternoon, police arrested four individuals following an investigation into the events preceding the death of LSU student Madison Brooks, who was struck by a vehicle on Burbank Drive last week. Madison was a daughter, a granddaughter, a sister, a niece, a classmate, and a friend to many of you. By all accounts, she was an amazing young woman with limitless potential. She should not have been taken from us in this way. What happened to her was evil, and our legal system will parcel out justice.Our collective grief and outrage cannot be put into mere words. So what can we do? It is time for action. One place to target our attention is the very place where this encounter began.All but one of the suspects involved in this horrific scenario were underage yet were able to consume alcohol at a local bar. As such, our action plan starts with a deep and relentless focus on any establishment that profits off our students by providing alcohol to underage individuals. In the coming days, we will call a meeting with these business owners to discuss how their responsibilities directly impact the safety of our students. We will work openly against any business that doesn’t join us in efforts toward creating a safer environment for our students. Enough is enough.Real and long-lasting solutions require multiple strategies, so we will not stop there. That is why I am asking our entire Baton Rouge community, from business leaders to citizens, to work together and join us in this effort. We will share additional action items in the coming days, but for now please join me in keeping Madison’s family in our thoughts and prayers.The Louisiana Office of Alcohol and Tobacco Control announced an emergency suspension of Reggie's Bar.Louisiana ATC released the following statement:The Louisiana ATC is working with Baton Rouge ABC and local law enforcement to investigate and share evidence regarding recent incidents at this establishment. Due to the seriousness of the allegations and the potential threat to public safety, an emergency suspension will be issued today. This action immediately suspends the service or sale of alcoholic beverages at this location. An emergency hearing will be held next month to determine what penalties (if any) should be imposed following a presentation of the evidence.
