Tamra Barney retains joint custody of her children after a judge dismisses ex-husband Simon Barney's claims of 'parental neglect' 

They've been involved in a bitter custody battle over their three children.

And Tamra Judge has obtained a legal win over ex-husband Simon Barney after a judge dismissed his motion to change the circumstances of their custody agreement due to lack of evidence of any 'parental neglect.'

Following the judge's decision Thursday, the Real Housewives Of Orange County star triumphantly tweeted: 'I won!!!!!!'

Tamra will continue to have 50/50 custody of their two youngest children - Spencer, 14, and Sophia, 8 - with another hearing set for December regarding their 15-year-old daughter Sidney.

Sidney has been living full-time with her father for the last year ever since Judge texted her that she was no longer welcome in her house.

'My daughter decided to move out for no reason and it’s been the worst year of my life,” a teary Tamra testified, revealing Sidney blames her mother for 'ruining her dad's life and he can't get a job because of the things I said publicly.'

'I hope that by bringing this court action it will force her to, hopefully, become a better mother,' Simon told Radar Online.

'If that happens, everyone wins...I would have been remiss if I did not fight to protect our children.' 

When he took the stand, Barney cited the following incidents of neglect: Spencer's injured finger, Sophia being late to school, Sophia coming home unbathed, and their frequently soiled underwear.

The child therapist Renee Hulse concluded: 'I have never heard anything that would indicate that she has ever done anything out of the ordinary, that [she] would hurt, abuse or neglect her children in any way'

The Bravo star - who has since remarried to fitness trainer Eddie Judge - responded that Spencer's jammed finger did not stop him from playing video games and the reason Sophia missed bathing on one occasion was because she was battling the flu.

'I am very excited that it is over for my kids sake,' Tamra told RealMrHousewife.com.

'I'm looking forward to repairing my relationship with my daughter that Simon ruined...We will go back to court in December for my older daughter, Sidney, after she starts court ordered therapy.'

In a declaration obtained by Radar, Sidney's therapist Renee Hulse concluded: 'I have never heard anything that would indicate that she has ever done anything out of the ordinary, that [she] would hurt, abuse or neglect her children in any way.'
