UNION (WBNG) -- The Broome County Sheriff’s Office said an “undocumented” asylum seeker, who crossed the southern border into the country, was arrested after they broke into someone’s home in the Town of Union on March 22.

The sheriff’s office charged Miguel A. Martinez, 31, with burglary in the second degree, a class C felony.

Around 8:18 p.m., patrols responded to a report of suspicious activity in and around an apartment building on JFK Boulevard. The investigation revealed that Martinez had broken into a second-floor apartment through a bedroom window. The office noted that noises had alerted a downstairs neighbor, who called 911.

Martinez was placed into custody without incident with assistance from the New York State Police.

The sheriff’s office said he was arraigned at Central Arraignment Part and remained in custody at the Broome County Correctional Facility. The office said it made Immigrations & Customs Enforcement, or ICE, aware of his arrest and will coordinate a transfer at a later date.
