Bailey social security charges on hold as judge seeks more information

Troy Bailey Sr., 57, of Williamsport, a suspect in the January killings of Ronald Dailey Jr. and Alisha Seese, will await a decision on whether he will stand trial on charges for using his son’s Social Security number to obtain employment and benefits, PennLive.com reported.

More research into a legal issue related to identity theft is needed before issuing his ruling, Lycoming County District Judge Christian Frey said following a preliminary hearing Tuesday.

To be found guilty of that offense, the prosecution must prove the accused used identifying information of another without their consent, but no evidence was presented during the hearing as to whether Troy Bailey Jr. had given his father consent to use his number, according to PennLive.com.

While there was testimony that Bailey was paid nearly $30,000 between 2021 and earlier this year working under his son’s Social Security number and received food stamps and other benefits, Frey questioned whether the prosecution needed to present something from his son, PennLive.com reported.

Bailey Jr. has been serving a life sentence in Philadelphia for murder since 2019.

Three counts of forgery were dismissed by Frey.

Assistant District Attorney Matthew B. Welickovitch immediately refiled them under a different section, also adding a third count of false statements that alleges Bailey unlawfully obtained $7,728 in Social Security benefits between December 2022 and this January, according to PennLive.com.

The new count is in relation to Bailey allegedly unlawfully obtaining Supplemental Nutrition Assistance Program (SNAP) benefits during two periods in 2023.

The revised charges on which Frey will rule are three counts each of forgery, identity theft, theft by deception and false statements, PennLive.com reported.

Bailey is currently incarcerated at the Lycoming County prison on several charges related to the double homicide as separate incidents of well child sex assault.
