INDIANAPOLIS — A lawsuit filed by the family of five of the victims killed in a mass shooting at an Indianapolis FedEx facility three years ago was dismissed this week.

According to a court order filed in the United States District Court for the Southern District of Indiana Indianapolis Division, the case was dismissed “without prejudice” on Friday.

While the court documents obtained by FOX59/CBS4 confirm that the case was dismissed, no other details were immediately provided.

The shooting occurred on April 15, 2021, when a former employee opened fire at the FedEx Ground Facility located on Mirabel Road. Eight people were killed, with four of the victims belonging to the Sikh community. Five more people were injured before the gunman shot himself.

The victims killed in the shooting were:

  • 32-year-old Matthew R. Alexander
  • 19-year-old Samaria Blackwell
  • 66-year-old Amarjeet Johal
  • 50-year-old Jasvinder Kaur
  • 68-year-old Jaswinder Singh
  • 48-year-old Amarjit Sekhon
  • 19-year-old Karli Smith
  • 74-year-old John Weisert

The incident went down as the most deadly mass shooting in the history of Indianapolis.

According to previous reports, the lawsuit accused Securitas Security Services, USA of providing inadequate security and negligence in the period leading up to the shooting and during the incident itself.

The lawsuit also listed FedEx Corporation, FedEx Ground Package System, Inc., Federal Express Corporation, and FedEx Corporate Services, Inc. as defendants.

The lawsuit alleged that the shooter passed through an unrestricted, ungated parking area near the facility before exiting his vehicle and being confronted by security.

Following this interaction, the lawsuit stated that the shooter returned to his vehicle and emerged with a gun when he began firing at employees in the parking area. The gunman eventually made his way to the inside of the facility where he shot more people.

The lawsuit also focused on the shooter’s history of “emotional and mental instability” that he allegedly demonstrated during his time working at the FedEx Ground facility between August and October of 2020.

The lawsuit asserted that FedEx did not have enough security measures in place considering that former shootings occurred in recent years at FedEx Ground Package facilities in Bedford Park, Illinois and Kennesaw, Georgia. The Kennesaw shooting saw six people injured after a former employee opened fire.

The lawsuit pointed to a lack of records that were made available by law enforcement agencies during the initial investigation, claiming that open records requests and other evidence such as witness interviews, surveillance footage and scene photos were withheld.

The findings of an investigation conducted by the FBI, Indianapolis Metropolitan Police Department and Office Southern District concluded that the shooter did not receive any help while carrying out the shooting and that a racial ideology did not influence the attack.
