BLOOMINGTON — A Chicago man remains on pretrial release, facing drug trafficking charges in McLean County.Â
Leonard Saunders, 38, appeared in court Tuesday with his attorney, Herschel J. Rush, during which Assistant State's Attorney David Fitt filed a petition to deny Saunders pretrial release.Â

Saunders first appeared in court on Monday, but since his attorney, Rush, was unavailable, the court continued the hearing to Tuesday.Â
He is charged with one count each of controlled substance trafficking and unlawful possession of a controlled substance with the intent to deliver, Class X felonies, and one count of unlawful possession of a controlled substance, a Class 1 felony. Each charge involves more than 900 grams of a substance containing cocaine.
According to a probable cause statement, Saunders was pulled over by McLean County sheriff's deputies on April 13 while traveling northbound on Interstate 55 for driving 75 mph in a 70 mph speed limit zone.Â
During the stop, deputies discovered Saunders had an outstanding warrant in Cook County for a civil case, Fitt said.Â
Saunders was detained, and the vehicle, a rented white Jeep, was searched, Fitt said.Â
During that search, more than $10,000 in small bills wrapped in bands was found alongside equipment used to package and sell drugs, including baggies and a scale, Fitt said.Â
Underneath the floor panel in the rear of the vehicle, authorities from the sheriff's office found approximately 1,100 grams of a substance that field tested positive for cocaine, Fitt said.Â
Fitt argued Saunders should be denied pretrial release based on the dangerousness of the charges, saying controlled substance trafficking is a detention eligible offense and is also a danger to the community at large.Â
He argued, as Saunders has no ties to McLean County, he is likely not to comply with any court order of release and should be detained.Â
Saunders' attorney, Rush, argued his client has no criminal history besides a domestic violence charge from 14 years ago in Indiana, and there are no indicators that Saunders would not comply with court orders.Â
Rush argued Saunders was "presumed not guilty" under the Pretrial Fairness Act and said his client "is not someone who's been a danger to the community."Â

Judge Amy McFarland ruled the state met its burden of proof that the charges are detention eligible, and the charges meet the dangerousness standard, but the state fell short in proving Saunders would not comply with any release conditions.Â
McFarland denied the state's petition and ordered Saunders released pending trial with mandatory and discretionary conditions.Â
The conditions include requiring Saunders to remain in Illinois, not consume or possess alcohol, cannabis or illicit substances without a valid prescription and, upon his release from Cook County for an outstanding warrant, report to McLean County Pretrial Services.Â
His next court date is an arraignment at 9 a.m. April 26.

His bond was set at $150,000 with 10% to apply. His next court date is 10 a.m. July 28
