LOUISVILLE, Ky. (WDRB) -- Attorneys for Delphi murder suspect Richard Allen are asking the court to block jurors from hearing a recorded police interrogation, claiming that Allen’s civil rights were violated, reported by FOX59.

Allen is claiming he was never read his Miranda Rights during his interrogation.

The request to block the recording was filed Monday.

Allen, 51, was arrested in October 2022 and charged with two counts of murder in the 2017 slayings of 13-year-old Abigail Williams and 14-year-old Liberty German. The Delphi, Indiana man has pleaded not guilty to the charges.

Attorneys are also claiming that ISP officials lied to Allen during the process. 

According to court documents, they claim either a camera was turned on minutes into the interview or the beginning of the interview was edited out.

Both of Allen’s attorneys wrote in Monday’s filing that, in the 70+ years of experience they have, this is "highly unusual" police behavior. They also said that Allen was held in the small, windowless interrogation room for over 2 hours without being allowed to leave, according to FOX59.

Allen was expected to go to trial in October. Defense lawyers asked for it to be moved up. It is now scheduled to start in May.
