The Attorney General of Indiana is a constitutional executive officer of the Indiana state government. The attorney general is the chief legal officer for Indiana. He or she is responsible for the prosecution of all civil actions brought in the name of the state of Indiana or any state agency.[1] Attorneys General are directly elected by the citizens of Indiana in presidential election years. They serve four-year terms and are not subject to term limits.[2]


Indiana has a Republican triplex. The Republican Party controls the offices of governor, secretary of state, and attorney general.

Current officeholder

The current attorney general is Republican Todd Rokita. He was first elected in 2020 and was sworn into office on January 11, 2021.[3]

Authority

Title 4, Article 6, Chapter 1, Section 2 of the Indiana Code addresses the office of attorney general:[4]

There is created the office of attorney general for the state to be administered by an attorney general who shall be elected under IC 3-10-2-6 by the voters of the state...

Qualifications

Qualifications for the office of attorney general are set out in Title 4, Article 6, Chapter 1, Section 3 of the Indiana Code. To be eligible to serve in the office, an individual must be:[4]

  • a resident of Indiana for at least two years prior to the election
  • licensed to practice law in Indiana for at least five years prior to the election

Indiana elects attorneys general in the presidential elections, that is, in leap years (e.g. 2016, 2020, 2024, 2028). The four-year term begins on the second Monday in January following the election.[5]

Duties

The Attorney General of Indiana is responsible for the prosecution of all civil actions brought in the name of the state of Indiana or any state agency.[1]

Campaign finance

The Attorney General of Indiana is responsible for all prosecution of criminal campaign finance complaints. The first step in filing a complaint is to file with the Indiana Secretary of State. The secretary of state's office is responsible for investigating all complaints. The Indiana Election Commission is responsible for handling all civil law violations.[6]

The salaries of executive officers in Indiana are determined by the Indiana State Legislature. In 2007, the Indiana Senate passed SB 401, which tied annual salary increases to increases received by state employees. State executive officials are not eligible for salary increases if state employees do not receive increases to their salaries.[9]
