Couple married for 21 years divorced due to clerical error

(WJW) – A couple married for 21 years divorced because of a mistake.

According to The Guardian, an order for the divorce of the couple was accidentally applied for when an employee at Vardags law firm “clicked the wrong button” in an online portal.

According to the report, the lawyers intended to complete a divorce for another client.

Lawyers realized their mistake two days later and applied for an appeal, however the judge denied their request, according to The Guardian.

“There is a strong public policy interest in respecting the certainty and finality that flows from a final divorce order,” Sir Andrew McFarlane said.

The couple separated in 2023 and was working out financial details of the split.

Ayesha Vardag, Head of Vardags firm, called out the judge in a statement seen by PEOPLE.

“The state should not be divorcing people on the basis of a clerical error,” Vardag said. “When a mistake is brought to a court’s attention, and everyone accepts that a mistake has been made, it obviously has to be undone.”

The judge did say in his ruling that the online divorce portal system needed to be fixed, so that a final order of divorce could not be submitted with “the click of a wrong button.”
