The Greenberg's attorneys were in court Tuesday, in regards to a lawsuit filed against the City of Philadelphia, and the Medical Examiner's Office, in the case of their daughter Ellen's death.

Ellen Greenberg died in 2011 at 27-years-old, after being stabbed dozens of times in her apartment in Manayunk.

Her manner of death was changed from a homicide to a suicide, and since then, her family has been fighting for justice.

The Greenberg's allege there was a cover up when the city and medical examiner changed the manner of death.

They believe by filing the lawsuit, they'll be able to hold everyone accountable in a civil case.

The attorneys of the family said Tuesday that a former Assistant District Attorney for the Philadelphia DA's Office is willing to testify for them, alleging Ellen's body was moved after she was killed.

They say that ADA, Guy D'Andrea, did a review of the case after Ellen's manner of death was changed.

The ADA said he will testify that he spoke with the then medical examiner, who claimed Ellen's body had to be moved from laying on the ground to a sitting up position, that they found her in. Attorneys said they were able to tell that by how blood on Ellen's face dried up.

He also says there was no evidence that emergency responders were the ones who moved her body.

The court is allowing the Greenberg's attorneys to move forward with discovery and depositions in the case, and they have a deadline to get that done by May 6th, 2024.

The hope for the family is that this civil case goes to trial in the fall.

In October of 2023, The Greenberg's appealed the manner of death, bringing it to the PA Supreme Court.

In terms of that case, their attorneys say the justices haven't decided whether to take it up or not.
