AFTER RUNNING OUT OF GAS.. AND NO ONE WAS HURT, BUT STATE POLICE SAY THIS IS STILL AN ACTIVE AND ONGOING INVESTIGATION.. <WITH A HANDGUN. ON THE SIDE OF THE ROAD, SHOOTING INTO THE GROUND, TO THE GRASSY AREA> THOSE GUN SHOTS.. ALLEGEDLY áFIRED BY 41 YEAR OLD RICHARD CRUZ RODRIGUEZ ON THURSDAY NIGHT ALONG EYE 93 NORTH IN SALEM. <ITS NORTHBOUND AT .6 RIGHT HAND SIDE, MALE IS OUTSIDE THE VEHICLE, WEARING A FLANNEL SHIRT AND JEANS> COURT DOCUMENTS SHOW MULTIPLE CALLS MADE áTO POLICE áBY WITNESSES.. WHO SAY THEY HEARD GUNSHOTS JUST BEFORE EXIT ONE. THE PAPERWORK ALLEGES RODRIGUEZ WAS DRIVING HOME TO MANCHESTER FROM MASS GENERAL HOSPITAL.. WHEN HE RAN OUT OF GAS... EVENTUALLY PULLING INTO THE BREAKDOWN LANE NEAR MILE MARKER 0.6. RODRIGUEZ.. TELLING POLICE HE SHOT HIS GUN áTWICE ... TO QUOTE "GET ATTENTION".. AFTER GETTING NO RESPONSE FROM THOSE HE ORIGINALLY CALLED FOR HELP. NEW HAMPSHIRE STATE POLICE SAY RODRIGUEZ THEN TOLD OFFICERS HE WAS WAITING FOR THEM TO ARRIVE AFTER FIRING THE GUNSHOTS -- BUT THAT HE áALSO TOLD THEM HE UNDERSTOOD SHOOTING AT THE GROUND TO ATTRACT HELP WAS QUOTE "EXTREME." RODRIGUEZ, ADMITTING TO POLICE THAT HE WAS DRINKING ALCOHOL BEFORE DRIVING TOWARDS MANCHESTER -- ADDING HE WAS STRESSED OUT AFTER VISITING HIS DAD AT THE HOSPITAL. HE'S NOW FACING CHARGES OF RECKLESS CONDUCT WITH A DEADLY WEAPON, FELONIOUS USE OF A FIREARM AND DRIVING WHILE UNDER THE INFLUENCE. A New Hampshire man is facing several charges after Salem police said he shot a gun in the breakdown lane of Interstate 93 and drove while under the influence.Richard Cruz Rodriguez, 41, of Manchester, was charged with reckless conduct, felonious use of a firearm and driving under the influence.Police said they were called Thursday evening to I-93 North in Salem after witnesses reported that a man was shooting a firearm in the breakdown lane.>> Download the free WMUR app to get updates on the go: Apple | Google Play <<According to court documents, Rodriguez told officers he was traveling back to Manchester from Massachusetts General Hospital when he ran out of gas. He said he tried calling people for help, but no one was responding.Rodriguez told police he fired his gun twice to get someone's attention and to get help, according to court documents. He also told police he didn't aim the gun toward any cars.A probable cause hearing is scheduled for April 18. Police said the investigation is ongoing.

According to court documents, Rodriguez told officers he was traveling back to Manchester from Massachusetts General Hospital when he ran out of gas. He said he tried calling people for help, but no one was responding.

Rodriguez told police he fired his gun twice to get someone's attention and to get help, according to court documents. He also told police he didn't aim the gun toward any cars.

A probable cause hearing is scheduled for April 18. Police said the investigation is ongoing.
