Two new lawsuits filed against concrete truck driver in Hays CISD bus crash

The eighth and ninth lawsuits have been filed against the driver of a concrete truck that crashed into a Hays CISD bus in Bastrop County last month, killing two.

Both lawsuits were filed by parents of children on the school bus. They say their children suffered serious and traumatic injuries as a result of the crash. They are requesting a trial by jury.

The crash happened on State Highway 21 on March 22. According to a report by the Texas Department of Public Safety, Jerry Hernandez was driving the FJM Concrete Pumping truck that crossed over the double yellow line and collided with a school bus carrying 44 children and 11 adults. It then crashed into the car of 33-year-old Ryan Wallace.

Wallace, along with 5-year-old Ulises Rodriguez Montoya, died. Both families have filed separate lawsuits.

Hernandez said he consumed cocaine the morning of the crash. The previous night, he smoked marijuana and only got a few hours of sleep.

The recent lawsuits claim Hernadez was an “incompetent, reckless, and/or unfit driver” who created “an unreasonable risk of danger to persons and properties on the public streets and highways of Texas.”
