Chelmsford Man Accused Of Fatal DUI Crash Indicted
James Scoville, of Chelmsford, was driving drunk when he struck and killed a man in Medford in 2016, prosecutors said.
WOBURN, MA — A Chelmsford man was recently indicted on charges he was drunk when he struck and killed a highway worker in Medford in 2016. James Scoville, 33, was charged with motor vehicle homicide and operating a motor vehicle under the influence of alcohol causing serious bodily injury. He was indicted on those charges in November in Middlesex County Superior Court in Woburn.
The worker killed was Thomas O'Day, 52, of East Bridgewater. O'Day was a Hi-Way Safety Systems worker. Another worker was injured in the crash but survived.
The crash happened in Medford on Interstate 93 June 28, 2016, at about 2:30 a.m., authorities said.

"(The workers) were performing painting work in a lane that was closed due to the roadwork," Middlesex District Attorney Marian Ryan said in a statement Monday. "Authorities were informed that the defendant allegedly drove through the lane closure before striking Thomas O'Day and then crashing his motor vehicle into a construction truck which contained the second male victim. The defendant remained on scene. State Police then allegedly observed the defendant to be under the influence of alcohol."
An indictment means a grand jury has determined a trial is warranted based on evidence in the case.
