CUYAHOGA COUNTY, Ohio — A Cuyahoga County grand jury has now indicted a man for a carjacking and a fatal crash that killed a woman, and court records also now reveal the suspect was driving drunk.

Brian Burns has been indicted for aggravated vehicular homicide, robbery, grand theft, receiving stolen property and driving under the influence.

Police say he carjacked a man leaving the St. Rocco’s church festival on Cleveland’s west side Labor Day weekend. Then police say he drove wildly and crashed into Shirley Duncan-Barnes. Investigators say Burns pushed the victim’s car into a building in the Lee-Harvard area.

Cleveland accident investigators found Burns had a blood alcohol level of .15, nearly twice the legal limit.
