Minnesota man charged with rape, assault in Marshall County

A Minnesota man has been indicted on charges of rape, sexual contact, domestic aggravated assault and cruelty to a minor, according to a news release from the Attorney General’s Office.

Michael D. Elsberry, 51, of Braham has been indicted by a Marshall County grand jury. His next court appearance is Sept. 18. According to court paperwork, these are the details concerning the felony charges:

• Rape: Involved a 35-year-old and was between May and December 2015. The maximum penalty is 50 years in prison and a $50,000 fine.

• Two counts of sexual contact with a child under the age of 16: From incidents between Dec. 28, 2013, and Dec. 27, 2014. The maximum sentence on each count is 15 years in prison and a $30,000 fine.

• Two counts of domestic aggravated assault: One incident was in 2015 and involved a 35-year-old who was hit with a belt. The other was between Dec. 1, 2012, and Sept. 30, 2014, and involved the hitting or kicking of a child between the ages of 9 and 11. The maximum penalty on each count is 15 years in prison and a $30,000 fine.

• Abuse or cruelty to a minor: Elsberry hit or kicked a child between the ages of 9 and 11 between Dec. 1, 2012, and Sept. 30, 2014. The maximum penalty is 10 years in prison and a $20,000 fine. This is an alternate count to one of the domestic assault charges, so he could only plead or be found guilty of one of the counts.
