Curse words, gang talk fill courtroom as judge reads Jessica Kelley’s phone calls
Curse words were flying as one of the women charged with killing and dismembering 10-year-old Victoria Martens in 2016 was in court Thursday.
Prosecutor Greer Rose read a transcript from phone calls between suspect Jessica Kelley and her family member.
"You know I'm a gang member. And I xxxx up. I xxxx up, Rose said referring to the phone call."
"That phrase I xxxx up judge is sometimes used by drug users when they relapse," Rose read.
The state wants Kelley's prior drug use and some of those recorded jail house phone calls allowed at trial. The judge wasn't yet convinced.
"It doesn't say I was xxxx up. It says I xxxx up. That's no different than any man who's ever made his wife mad," District Court Judge Charles Brown said.
The judge said he wanted to hear the calls before making a decision which ones will be allowed at trial. He also wants to see graphic photos and videos of the crime scene before jurors do.
The defense asked the judge to move this case out of Bernalillo County saying the case has gotten so much media attention, Jessica Kelley can't get a fair trial.
The judge said Kelley is the first of three people charged with Victoria's death to go to trial. He said for now, he's keeping it in Bernalillo County.
One of the calls the state is asking to be allowed at trial is a call between Kelley and her sister. The call was made hours before 10 year old Victoria Martens was raped, murdered and mutilated.
