Attorneys for Cristhian Bahena Rivera requested that the judge throw out his confession, because police interrogators did not fully explain Bahena Rivera's rights to him.
The court media coordinator informed KCCI Tuesday morning that the hearing has been delayed due to a death in one of the defense attorney’s families . A new date for the hearing has been set for November 13 at 9 a.m.
On Friday, prosecutors agreed that some of Bahena Rivera's interrogation should be suppressed, but not all of it.
Attorneys for Bahena Rivera also plan to call two expert witnesses to testify about sleep deprivation during interrogations.
Court documents reveal some of the evidence that prosecutors hope to use in the trial.
Defense exhibits include Rivera’s expert translation of interviews, written consent to search of the Chevy Malibu (in Spanish), written consent to search of a Nissan Altima (in Spanish), written consent to search of the Chevy Malibu (in English), immigration detainer, a map, a Brooklyn Fire Department Volunteer’s logs, 17 crime scene photos and a Miranda card.
Prosecution exhibits include video interviews of Rivera, including one following the discovery of Tibbetts’ body, transcripts of interviews, multiple photos and maps of the location where Tibbetts’ body was found, a summary from Rivera on the timeline of events and consent forms to search vehicles in Spanish.
