Lorry driver who killed motorist after suffering dizzy spells shouldn’t have been behind the wheel

Sheriff told Jedburgh Sheriff Court Dr Davies should have recommended a total road ban to Power, of Annan, Dumfries-shire

A TRUCKER who killed a motorist after suffering dizzy spells at the wheel should have been told by a doctor not to drive, a sheriff ruled.

John Power, 65, ploughed into James Miller’s car following a “sudden loss of disorientation” in his lorry.

James, 64, of Hawick, Roxburghshire died in a fireball when his Vauxhall Cavalier was shunted off the A7 near Teviothead.

A fatal accident inquiry heard the December 2015 horror was the third time in six months Power became giddy — including once while pushing pallets at work.

Dr Paul Davies, of North Cumbria University Hospitals NHS Trust, advised Power not to drive HGVs.

But the trucker and bosses at J Dickenson Transport felt he could control the 7.5-tonne Renault box lorry before the deadly crash.

Sheriff Peter Paterson said the “advice on driving was incorrect”.

He told Jedburgh Sheriff Court Dr Davies should have recommended a total road ban to Power, of Annan, Dumfries-shire.

He added future decisions should be based on drivers’ health, not vehicle size. North Cumbria Uni Hospitals Trust did not comment.
