Homeless Man Accused Of Raping 75-Year-Old Sebastopol Woman: PD

Police said the 26-year-old admitted to officers he had had sex with the woman and was there to visit her again.

SEBASTOPOL, CA — A 26-year-old man was arrested on Friday for allegedly raping a 75-year-old woman in Sebastopol who was incapable of consenting to sexual intercourse, police said.

The assault was first reported on Sept. 5 when the woman, along with family members, filed a report at the police department. The woman had trouble recalling the details of what had happened and her family argued she was incapable of consenting.

Detectives collected evidence that the woman likely had intercourse with someone without consent and in fact was incapable of consenting. But the woman and her family could not provide the identity of her attacker.

On Friday, witnesses found a man loitering outside the woman's residence and convinced him to stay in the area while they called police.

Officers arrived and found Tirso Guzmanvivar, a homeless man whom police said had many prior contacts with officers. Police said that he admitted to the officers he had had sex with the woman and was there to visit her again.

Guzmanvivar was arrested on suspicion of rape and booked in Sonoma County jail on $450,000 bail.
