A South Daytona man was arrested Tuesday and accused of fatally shooting a man at an apartment complex in Daytona Beach during an argument on Monday, police said.

Zion Counts, 21, was charged with premeditated first-degree murder and possession of a firearm by a convicted felon, said Carrie McCallister, Daytona Beach police spokeswoman.

On Monday at 1:10 p.m. Timothy Seamore Jr., 26, was fatally shot near 841 Magnolia Ave., police said.

According to an arrest report, witnesses identified Counts as the shooter. Seamore and Counts had been arguing when the gunfire broke out, police said.

After Seamore fell to the ground, Counts stood over him and shot him in the head, police said.

According to McCallister, callers to 9-1-1 dispatchers reported hearing multiple gunshots in the neighborhood followed by a female screaming.

When responding officers arrived they found Seamore on a sidewalk with a gunshot wound. Daytona Beach fire and Volusia County paramedics pronounced Seamore dead at the scene at 1:18 p.m., authorities said.

Officers cordoned off the immediate area and detectives arrived on scene and recovered evidence and sought witnesses, McCallister said.

It took Daytona Beach police 25 hours of investigative work to solve Seamore's murder, McCallister said.
