Dakota County man accused of firing on police multiple times until arrested by SWAT

Sep. 22—A 38-year-old man was in custody Wednesday after police said he shot at them with a rifle.

Brian Lusk, of Marshan Township, is being held at the Dakota County Jail in suspicion of second-degree assault, damage to property and illegally discharging a dangerous weapon.

According to the Dakota County Sheriff's office, deputies responded to a 911 hang-up call about 10 p.m. Tuesday from an apartment building in the 19000 block of Lena Avenue in Marshan Township which is located southeast of Rosemount.

When they arrived, deputies made contact with Lusk who at the time did not appear to be a threat to himself or others, the sheriff's office said.

Shortly after, deputies heard a loud bang and realized it was a gunshot. Lusk allegedly continued to fire shots at law enforcement, the sheriff's office said.

No one was injured. Deputies were able to remove residents from the area while the situation unfolded.

At 3:05 a.m. Wednesday, Lusk stepped out of his apartment armed with a rifle and was taken into custody by the South Metro SWAT Team, the sheriff's office said.

Lusk's criminal record shows he pleaded guilty to a fifth-degree assault charge in 2003 as well as four DWI convictions.

He will make his first court appearance Friday in Hastings.
