IT WAS A CRASH THAT LANDED THE SCHOOL BUS PARTIALLY IN A POOL FRIDAY MORNING. 9 CHILDREN WITH SPECIAL NEEDS FROM MAGNOLIA SCHOOL WERE THANKFULLY UNHURT, TRANSFERRING TO ANOTHER BUS AND ON TO SCHOOL. TROOPERS HAVE NOW CONCLUDED THE CRASH WAS CAUSED BY BOTH DRIVERS. BUS DRIVER 53-YEAR-OLD EDDIKSON PENA, FOR CROSSING THE DOUBLE YELLOW LINE, WHEN THE LAW SAYS DRIVERS WITH PART OF LANE BLOCKED ARE SUPPOSED TO WAIT FOR ONCOMING TRAFFIC TO CLEAR. >> HE’S HAVING TO DO THAT BECAUSE THERE ARE PARKED VEHICLES PROHIBITING HIM FROM STAYING IN HIS LANE. DAVE: BUT HE’S NOT THE ONLY ONE GETTING A TICKET. 25-YEAR-OLD YERICA VILORIO CUEVAS WAS CITED FOR FAILING TO USE DUE CARE. THE ON BOARD VIDEO, WHICH IS NOT BEING RELEASED, HELPED PAINT THAT PICTURE FOR INVESTIGATORS. >> IT WAS NOTED THAT OTHER VEHICLES WERE SAFELY PASSING HIM AS HE REMAINED SLIGHTLY OVER THAT DOUBLE YELLOW LINE, SHE SHOULD HAVE BEEN ABLE TO DO THE SAME. DAVE: ANOTHER THING THAT CONTRIBUTED TO THAT CONCLUSION, NO SUDDEN MOVEMENT BY THE BUS. >> THE BUS DRIVER STAYS STRAIGHT SO THERE WAS NO SWERVING INTO HER LANE THAT WOULD CAUSE A SUDDEN PANIC. DAVE: SHARED RESPONSIBILITY FOR THE WRECK, BUT WHAT ABOUT THE NEEDED REPAIRS? I SPOKE WITH THE HOMEOWNER AND HE’S STILL ASSESSING THE TOTAL DAMAGE SO HE CAN FILE AN ACCURATE CLAIM. EVEN THOUGH THE BUS DRIVER WAS OVER THE DOUBLE YELLOW LINE AS CARS WERE APPROACHING FROM THE OTHER DIRECTION, WHICH IS A VIOLATION, THEY GIVE HIM CREDIT FOR NOTICING HOW DEEP THIS EMBANKMENT IS WITH THE RETENTION POND AND INTENTIONALLY MISSING IT AND KNOCKING DOWN FENCING. An Orange County school bus driver is one of two people being blamed for a crash that ended with a school bus in a swimming pool. The school bus collided with an SUV on Willowwood Street and Rushwood Court off Hiawassee Road last week. The Florida Highway Patrol has now ticketed the bus driver, Eddikison Pena, 53, for driving over a double yellow line and the SUV driver, Yerica Vilorio Cuevas, 25, for failing to use due care.Nine children with special needs from Magnolia School were unhurt. They were loaded onto another bus and taken to school. Investigators said they used video from onboard the bus during their investigation. “It was noted that other vehicles were safely passing him as he remained slightly over that double yellow line. She should have been able to do the same," said Lt. Kim Montes, a spokeswoman with Florida Highway Patrol.Three children in the SUV suffered minor injuries.
