Falmouth Wind Turbines Infra-Sound Liability

Massachusetts town faces numerous legal issues before entering into an agreement with a partner

The Falmouth Select Board is working toward moving two town-owned wind turbines beyond Falmouth to another community.

The Falmouth Town Meeting approved 2.5 million in November of 2019 to take down the turbines.

The town owes more than $8 million-plus in debt related to the wind turbines. There is $3.5 million in bond payments remaining for Wind 1 the first turbine, which the town is mandated to pay. In addition, the town should be required to pay $3.5 million-plus 2 percent interest to the Massachusetts Clean Water Trust.

The town borrowed $ 5 million from the American Recovery and Reinvestment Act of 2009 which requires Falmouth Wind II the second turbine remains energy efficient or the loan is due.

The Massachusetts courts after eight years of litigation shut down the turbines. These type 110 decibel turbines are the apex of producing human discomfort, annoyance, and harm. In particular, infrasound and low-frequency noise (ILFN) harm because of impacts unique to this concoction of noise.

Former Governor Deval Patrick defended his report of wind turbines' effect on health inviting expert and public opinions and said he respected the study's findings. In that study it said wind turbines generating 110 decibels of noise do produce infrasound. The Falmouth wind turbines generate 110 decibels of noise each.

Falmouth maintaining ownership of the turbines out of town creates a new liability issue and maybe years more of litigation over bird deaths, communications interruptions or more health and property taking problems.

One major fact the news media and local politicians omit from the public is the Vestas V-82 type 1.65 megawatt turbines only cost 2.6 million each in 2005.

An acoustical study was conducted to investigate infrasonic and low-frequency noise emissions from wind turbines located in Falmouth, Massachusetts.

While conducting the study, the investigating acousticians experienced adverse health effects consistent with those reported by Falmouth residents. The authors concluded that the rapid onset of adverse health effects during the study confirms that wind turbines can harm humans if placed too close to residents.

The acoustician experienced in turbine noise warned that one Falmouth turbine would need to be situated at least 2923 feet from the nearest neighbor in order to remain in compliance with state and local noise regulations.

The Cape Cod Commission in Massachusetts several years ago adopted 10 X, ten times, the rotor diameter of the wind turbines to residential homes after massive noise complaints from at least twenty-one communities. In the case of one Falmouth Vestas V-82 type 1.65 megawatt wind turbine around 3000 feet.

There are no studies of two Vestas turbines operating at the same time.

Falmouth, Massachusetts is ground zero for poorly placed wind turbines in the United States taking health and property rights with no compensation.

The turbines create an easement over the neighboring residential properties that eliminate the owner from any further developments. This amounts to an uncompensated taking of private property rights

Falmouth local government charged with protecting the health and welfare of citizens hid emails, memos, a letter from August of 2010 and a study done for the Town of Falmouth in 2005 done by KEMA Inc shows that just one Vestas V -82 type turbine would affect up to 99 residential homes.

The Town of Falmouth cannot say any longer that they know of no adverse effects.
