Legal health concerns and safety have shut the rotor blades forever in June of 2017

Massachusetts Appeals Court upheld the Falmouth wind turbine decision the wind turbine facility is a nuisance and ordered that they be permanently shut down in June 2017. Wind turbines cause adverse human health effects that have been ascribed to the proximity of wind turbines.

Proponents have claimed that these effects include, the sub-audible sound goes on for hours, or even days, weeks, and years without interruption ..congenital abnormality, cancer, and even death from being driven crazy by two distinct types of noise.

The wind turbine facility consists of two town-owned Vestas V-82 type 1.65 megawatt wind turbines each capable of generating 110 decibels of noise each or two rock bands playing 24/7.

Falmouth Building Commissioner determined that the town’s wind turbine, Wind 1, is a non-complying structure and needs to come down. Falmouth Wind ! the first of two town-owned wind turbines has not operated since 2015.

Wind turbine expenses are appropriated in the Town’s operating budget line items and are funded through general operations but are not specifically designated as such.

These unknown specific wind turbine expenses for both include the following:

1. The amount required to fund the annual maintenance contract.

2. The approximate annual insurance premium.

3. The parasitic electricity going into the turbines power plant.

4. The cost to hire an engineering company on a yearly basis.

5. The cost to hire outside legal counsel.

6. Town Meeting voted 2.5 million in November 2019 to remove the turbine.

The Town’s second wind turbine, commonly referred to as Wind 2, was funded by an American Recovery and Reinvestment Act loan providing a 0% interest principal forgiveness loan. In order to comply with loan conditions, the Town is required to operate the turbines in an energy-efficient manner approved by the Mass Clean Water Trust (MCWT). According to the terms of the agreement, if Wind 2 ceases operation or possibly is curtailed further, the Town is required to pay back the $5,000,000 grant with 2 percent interest.

American Recovery and Reinvestment Act of 2009 Federal EPA Terms and Conditions in May 2009 does not allow the Town of Falmouth to create "a substantial and specific danger to public health or safety related to the implementation or use of covered funds."

The Massachusetts court system has determined the Town-owned wind turbines are a nuisance. ARRA funds should never have been used to build the wind turbine.

The ARRA loan outstanding debt on Falmouth Wind II is 3.5 million plus 2 percent interest.

Officials said; in June 2019 that nine organizations responded to the Town of Falmouth's request for letters of interest to move its two wind turbines ?

Note # Since November 2019 the Town of Falmouth has provided since 6 months no new update?
