QUINNESEC, MI - A Michigan man who claimed he swallowed a stray grill brush bristle has failed to persuade an appeals court to revive his lawsuit.

The Associated Press reports that Robert Kaminski, a resident of the small Upper Peninsula community of Quinnesec in Dickinson County, had surgery in 2014 to remove the metal bristle, which was ingested by mistake after he was barbequing chicken.

Kaminski had sued the maker of the grill brush, Arcola, Illinois-based The Libman Company, for negligence, but a federal appeals court ruled in favor of the company last week, the AP reported.

Judge Robert Jonker reportedly said the brush was a simple tool that wasn't unreasonably dangerous and didn't require warnings.

Kaminski also failed to cite other examples of Libman grill bristles causing injuries, according to the AP.
