A Georgia attorney thought a man hit his Mercedes with a golf ball. He ran him over and killed him, DA says

An Atlanta attorney was indicted for killing a man who may have hit his Mercedes Benz with a golf ball, the district attorney's office said.

Bryan Schmitt, 48, was indicted by a grand jury on charges of murder, felony murder and aggravated assault in the death of 60-year-old Hamid Jahangard, Fulton County District Attorney Paul L. Howard, Jr. announced Friday. Schmitt allegedly hit Jahangard, a prominent real estate investor, in the driveway of a rental property owned by the victim.

"Jahangard was struck by the vehicle and died two days later of blunt force trauma injuries to the head," the district attorney said in a release. "The fatal encounter stemmed from Jahangard accidentally striking Schmitt’s Mercedes vehicle with a golf ball."

Schmitt told authorities he was driving past the driveway when he saw Jahangard lean over a trash can and make a throwing motion with his arm before something hit his car, the Atlanta Journal Constitution reported.

Police said a golf ball was found near the scene, but the car wasn't damaged, per the Journal Constitution. Schmitt said he made a U-turn and confronted Jahangard, but as he tried to pull into the driveway, the victim threw the trash can in front of his car, causing him to swerve, hitting Jahangard, the newspaper reported.

But investigators say the 23-foot-wide driveway had plenty of room for Schmitt to turn around without hitting Jahangard and footage of the collision was not consistent with Schmitt's story.

“Schmitt’s vehicle plows into the driveway and is not the type of driving for someone to ‘turn around,’ ‘swerve to miss a garbage can,’” investigator J.T. Williams wrote in a report obtained by the Journal Constitution. “The speed used to vault the garbage can, lift the front end of his car up and to slam the victim down so hard it causes a massive skull fracture ... is not an accident."

Don Samuel, Schmitt's lawyer, said the video doesn't show the impact, and he  believes it will be "impossible" for the district attorney to prove Schmitt intended to kill Jahangard.

"He has no anger problems, he wasn’t angry," Samuel said. "This whole notion of this being road rage is so unfounded."

Schmitt was arrested Aug. 12 and has not been released, according to Fulton County Jail records.
