Prosecutors seek life in prison for 2019 Oceano murder case

29-year-old Robert Garay, 21-year-old Gabriel Garay, and 21-year-old Nathaniel Jara are facing first degree murder charges in the shooting death of Daniel Fuentes.

SAN LUIS OBISPO, Calif. -- San Luis Obispo County District Attorney is seeking life in prison without the possibility of parole in a 2019 Oceano murder case.

Investigators say Robert Joseph Garay, Gabriel Luis Garay and Nathaniel Alexander  Jara killed Daniel Fuentes on the night of April 2.

The three men are suspected members of thee Oceano 13 gang.

Prosecutors charged the suspects with premeditated murder back in August.

They’re also facing gang- related charges.

Investigators say Robert Garay used the gun to murder Fuentes.

All three defendants could have faced the death penalty, but prosecutors chose to pursue life in prison without the possibility of parole instead.

“As long as the death penalty is a lawful sentence in California, I will continue to perform my duty in a thoughtful and deliberate manner, considering all of the facts, when deciding whether or not the death penalty is appropriate,” said District Attorney Dan Dow.

Prosecutors say they made the decision based on the facts of the case and the defendant’s backgrounds.

They also spoke with the victim’s family members and investigators before making that choice.
