Witnesses said a black lab named "Sweetie" bit a jogger on Missionary Ridge after leaping down with other dogs from "The Castle" at 360 South Crest Road.
It was also testified in City Court on Thursday that dogs belonging to the Stohler family scared another jogger, causing her to drop down a wall into a kudzu patch where she was trapped for almost an hour.
Judge Sherry Paty ruled "Sweetie" a "potentially dangerous dog". She said Constance Stohler can retrieve the lab from the McKamey Animal Trust by paying $470, which includes $10-per-day boarding charges.
But she warned Ms. Stohler that she needs to make sure her dogs do not get out of her invisible electric fence again.
William Davis said he was jogging past the Stohler mansion, which neighbors have dubbed "The Castle," when several dogs started chasing him and one bit him.
He said he had $145 in doctor bills to treat the dog bite on his leg.
His wife said she is worried that one of the dogs might come after their seven-year-old child. She said the Stohler dogs come as far as their home on Eastview.
A female college student said she was jogging in the same location when the dogs appeared to be coming for her. She said she became so frightened that she fell down the wall. She said she lay by the wall for almost an hour until someone heard her cries and came to her aid. "I was terrified," she said.
Ms. Stohler said the family has two Labs who look alike and a McKamey Animal Center officer took the wrong dog. Officer Robert Morgan said he offered to take pictures of the two dogs and let Mr. Davis pick out the culprit, but he said Ms. Stohler declined.
The officer said he went to the door of the mansion after the dog bite and Dr. Dennis Stohler told him he was welcome to take the dog and he did not want them around. He said Ms. Stohler came to the center several days later and said her husband had no right to give up her dog and she wanted it back.
Judge Paty also directed that Ms. Stohler pay the medical bill for Mr. Davis.
