Charges Dropped Against 10-Year-Old Playing Dodgeball

A Canton boy was in legal trouble after a game of dodgeball gone wrong, but his mother said the victim's medical condition is to blame.

CANTON, MI — The case has been dismissed after 10-year-old boy from Canton was charged with aggravated assault after injuring another student, who had a pre-existing medical condition, duringa dodgeball game at school, according to NBC News.

The boy's mother, Cameishi Triplett Lindley, said that her son Bryce was suspended from Erikkson Elementary School "for throwing a ball back at a student during recess, while playing a game called TIPS/ DODGEBALL" on April 30, she explained on Facebook.

"After meeting with the Principal about why Bryce was suspended while the other students who fully participated in this game were not, the Principal disclosed that the injured student has a pre-existing condition," Lindley wrote, explaining he had a condition known as “Chronic brain stem infliction.”

"Clearly, this student should not have been playing a physical contact sport," she added.

Lindley started a fundraiser on Facebook hoping to raise $4,000 to cover a lawyer for her son. She's exceeded her goal, raising more than $15,000.

Wayne County Prosecutor Kym Worthy called the charge"certainly sustainable," but announced the case had been dismissed.

"I have no doubt that both families involved love their children and want the best for them. But I do think that there is a better way to go forward at this time," she said in a statement. "It is my earnest hope that both sides will come back to the table to work out a solution that benefits both of these children."
