The Miss United States of America pageant can, under the First Amendment, exclude transgender women from participating, a federal appeals court has ruled.
The U.S. Court of Appeals for the Ninth Circuit said in its Nov. 2 opinion that the pageant’s “natural born female” eligibility requirement did not violate the Oregon Public Accommodations Act and determined that the First Amendment’s defense against compelled speech protected the organization.
