LINCOLN, Neb. (KSNB) - A St. Libory company Tuesday surrendered its grain warehouse license to the Nebraska Public Service Commission.

In May 2022, the PSC filed a complaint against the Union Grain Company for overselling corn on several occasions in violation of state law. The Grain Warehouse Act prohibits warehouse licensees from operating with less grain in the warehouse than outstanding receipts issued for grain stored by valid owners, depositors, or storers of grain in the licensed warehouse. The PSC grain department conducted two audits where they found Union Grain Company oversold in corn.

The PSC dismissed that complaint in July 2022. At the time PSC Chair Dan Watermeier said, “The company has worked with our grain department to rectify the situation that led to the complaint.” At the time, the PSC announced that Union Grain had paid a penalty and agreed to operate its facility in accordance with PSC rules and regulations.

On Tuesday, the PSC said Union Grain surrendered its license. On Wednesday, the PSC announced that it was taking title to all the grain currently stored there. A PSC spokesperson told Local4 that the commission will contact people who have grain stored there. And they will provide the owners with a form to reclaim the grain.
