Says Mekhail Bora, as defence uses his contradictory statements to police, CBI to punch holes in his deposition.

Mekhail Bora, the son of murder accused Indrani Mukerjea and brother of victim Sheena, had a tough time in the CBI court on Monday, with the defence lawyer putting him through an intense grilling session that sought to raise questions on his memory.

At one point of time during the cross-examination, an exasperated Mekhail shot back, “I am not suffering from memory loss”.

Indrani’s lawyer Sudeep Pasbola seized some of Mekhail’s “contradictory” statements made to the Khar police and the CBI to punch holes in his deposition to the court.

Pasbola started with cross-examining Mekhail on his claims about visiting a pub in Mumbai with Indrani’s first husband and co-accused Sanjeev Khanna. Mekhail had earlier claimed that during the pub visit, Khanna had offered Mekhail two tequila shots after which he blacked out. The next day, he found himself in Masina, with his head shaved.

When Pasbola asked him whether he had told Khanna about enjoying cigarettes and gutkha with his friends to relax, Mekhail denied it. But Pasbola quiclkly pointed out that this was mentioned in his statements to the Khar police. Pasbola further stated that Mekhail had told the Khar police that after the pub night, he found himself in a hotel room and went back to sleep. “I cannot assign any reason why it is mentioned in my statement,” Mekhail told in the court.

Pasbola also asked Mekhail about a “fight” he had with Indrani after she told his friend that he was refusing to take up a job in Guwahati and send his grandparents to Mumbai, or shift with the entire family to Mumbai. After a lot of back and forth, Mekhail said, “I am not suffering from memory loss”.

Pasbola suggested that Mekhail refused to move with the family to Mumbai not because his grandparents would be put in an old-age home as he had suggested, but because Indrani would stop giving him money to take care of them, which he allegedly used on his expensive habits.

To prove the so-called expensive habits, the defence lawyer questioned about the cars he used — a Maruti Esteem, Tata Aria, and a second-hand Mitsubishi Lancer, amongst other.

Mekhail rebutted that none of the cars was in his name.

Pasbola also mentioned the five dogs that Mekhail kept as pets, which include a Golden Retriever, and an English Mastiff that he purchased in 2012 after selling his car. At present, he owns one Labrador.

Mekhail’s cross-examination is likely to continue today.
